California Pregnancy Disability Leave (PDL) is job-protected leave for an employee disabled by pregnancy, childbirth, or a related medical condition. It generally applies to employers with five or more employees. The available leave depends on the period of disability and applicable rules, up to the statutory four-month limit.

Disability leave and bonding leave answer different needs

PDL is tied to disability, not simply the arrival of a child. It may be needed before or after childbirth and can involve intermittent leave or a reduced schedule. California guidance does not impose CFRA's one-year and hours-worked eligibility requirements on PDL.

Bonding leave under CFRA, where the employee qualifies, is a separate consideration. Federal FMLA, disability benefits, reasonable accommodation, and employer-paid benefits may also be relevant. Avoid promising every employee one fixed combined duration without reviewing eligibility, medical needs, schedule, and the applicable protections.

What employers should review

  • Route the request to HR and explain the process without asking the supervisor to assess medical necessity.
  • Review permitted medical certification, the employee's schedule, and whether intermittent leave or another accommodation is involved.
  • Maintain separate tracking for PDL, CFRA bonding, FMLA coordination, and wage-replacement benefits where applicable.
  • Give payroll clear instructions for employer-paid time and benefit coordination while protecting medical information.
  • Plan for return or changing restrictions and obtain advice before assuming leave exhaustion permits an employment decision.

Employer example

A recently hired employee needs pregnancy-related medical leave before childbirth. HR checks PDL even though the employee may not meet CFRA's service requirements. Later, it separately evaluates bonding eligibility and any continuing accommodation needs. The process avoids denying one protection because the employee does not qualify for another.

Frequently asked questions

Must an employee work for a year before PDL can apply?

California PDL does not use CFRA's one-year and hours-worked eligibility test. Employer coverage, disability, and the other applicable requirements still need review.

Is PDL automatically paid by the employer?

PDL is a leave protection. Wage replacement may come from disability benefits, applicable paid-time arrangements, or employer benefits, which require separate coordination.

Is four months the same number of workdays for every employee?

No. The employee's schedule and the applicable calculation matter. Use current CRD guidance and an individualized leave record rather than a universal day count.
