Updated

The California Family Rights Act (CFRA) provides eligible employees with job-protected leave for qualifying family and medical reasons. It generally applies to employers with five or more employees, with employee service and hours requirements. CFRA is a leave-protection law, not a state wage-replacement benefit.

Coordinate leave without treating different laws as identical

CFRA and federal FMLA can overlap, but they are not interchangeable. Coverage, qualifying relationships, and the treatment of pregnancy-related disability can differ. PFL or disability benefits may provide income replacement during an absence, but benefit eligibility does not establish CFRA eligibility.

The employer's process should distinguish the absence request, legal eligibility review, notices, leave tracking, benefits coordination, and return planning. Managers need enough information to arrange coverage without receiving unnecessary medical details. A consistent intake process helps prevent different locations from making conflicting promises.

What employers should review

  • Identify the employee's work situation, service history, hours, requested reason, and anticipated dates for the eligibility review.
  • Evaluate applicable CFRA, FMLA, pregnancy-disability, accommodation, and other leave obligations separately before coordinating them.
  • Provide required notices and manage permitted certification requests through an appropriate HR channel.
  • Track leave used, schedule changes, benefit arrangements, and any employer-paid time with clear records.
  • Discuss return-to-work questions early and escalate accommodation issues rather than assuming the end of one leave entitlement ends every obligation.

Employer example

An employee requests time to care for a family member and uses the word FMLA. HR does not stop at the federal label. It checks whether CFRA or another protection applies, explains the process, and coordinates approved leave with payroll. The supervisor receives the coverage plan while sensitive supporting records remain restricted.

Frequently asked questions

Is CFRA the same as California Paid Family Leave?

No. CFRA concerns job-protected leave. PFL is an EDD wage-replacement benefit. An employee may interact with both programs for the same absence.

Does every employee qualify because the employer has five employees?

No. Employer coverage and employee eligibility are separate questions. Service, hours, qualifying reason, and other requirements must be reviewed.

Should CFRA automatically be counted against pregnancy disability leave?

No. California treats pregnancy disability and CFRA leave differently. Coordinate the applicable protections carefully rather than using one combined leave bucket.
