Employee Expense Reimbursement
October 21, 2026
Employee expense reimbursement is repayment of qualifying costs an employee incurs in performing work. In California, Labor Code section 2802 addresses necessary expenditures or losses incurred as a direct consequence of job duties or employer directions. Whether a particular expense qualifies requires review of the facts and applicable rules.
A clear policy should reflect how people actually work
Work-related costs can arise in field work, travel, remote work, or required use of personal equipment. A policy should explain how employees request reimbursement, what support is needed, who reviews exceptions, and how disputes are escalated. It should not assume that every expense outside a standard form is automatically the employee's responsibility.
Tax treatment is a separate question from whether the employer must reimburse an expense. A flat allowance, mileage payment, or repayment supported by receipts can require different payroll and tax handling. Coordinate policy design with payroll and qualified advisers before introducing a new arrangement.
What employers should review
- Identify the costs employees reasonably incur because of required duties, including work practices not captured in the existing policy.
- Provide an accessible submission process with instructions for missing receipts, recurring expenses, and manager-directed purchases.
- Review whether allowances or fixed amounts reasonably address actual obligations and how exceptions will be corrected.
- Keep approvals, supporting records, payment dates, and tax-treatment decisions together.
- Train managers not to discourage legitimate expense reports to keep departmental costs down.
Employer example
A company requires field employees to use personal phones for work scheduling and customer communication. HR reviews the actual requirement, available alternatives, and reimbursement approach with advisers. Payroll then implements the approved treatment and an exception process. Simply calling the phone use voluntary would not resolve a practice that managers require.
Frequently asked questions
Does a written policy settle every reimbursement question?
No. Actual duties, employer instructions, applicable law, and the expense itself matter. A policy should support the obligation rather than attempt to replace it.
Is every reimbursement automatically tax-free?
No. Tax treatment depends on the arrangement and documentation. Have payroll or a tax adviser review it separately from the employment-law requirement.
What should an employer do when an employee disputes an allowance?
Review the work-related costs and supporting information, document the analysis, and correct the arrangement when required. A fixed amount should not prevent a reasonable exception review.
