“As the owner of a large Janitorial Company in Sacramento, I felt exposed to risk because we didn’t have the employment law knowledge required to be a successful employer in California. We vetted and subsequently hired Employer’s Guardian to fill in those knowledge base gaps. EG has built our foundation of compliance as well as coached me and my team to improve employee performance. “It still amazes me that when I had a “professional” HR person on staff, my WC mod just went up and up. Fire the professional staff person, outsource and reap the benefits. I know now where the “professionals” really were. The quick way you cleaned up our open claims and made safety a priority has been immensely helpful. Your on-going reviews and recommendations keep us honest. Even though it was a struggle at first, your efforts are all paying off and you have a very grateful client.”

An employee handbook is a key piece of documentation. It’s not uncommon for companies to go years between handbook updates, and this can lead to unnecessary and potentially expensive exposure to risks. Laws change each and every year.
Ending up in court without a well-drafted employee polices to defend yourself, you’ll fight an uphill battle trying to defend yourself. When it comes to employment law, it isn’t necessarily how Fair you are, but rather knowing the rules, and playing the game by those rules. A quality handbook defines those rules and keeps employees or their legal counsel from attacking any cracks in your armor. Stay up to date with an Employer’s Guardian customized handbook.
Health and Safety Plan
A quality Health and Safety Program (HASP) includes an Injury and Illness Prevention Plan (IIPP), safety training, a commitment to safety policy, a list of all known hazards, hazard abatement and control, record keeping, and enforcement (positive or negative). We will visit your facility to identify hazards, then craft a thorough and customized HASP. Upon completion, Employer’s Guardian will train your Safety Officer on how to use the program to keep your employees safe and maintain Cal-OSHA compliance.
Employer’s Business Review
Compliance is a moving target. Knowing which areas your company is exposed to allows you and your management team can make educated decisions on which risks to minimize and when. Employees change over time; what motivated them in the past, may not today. Unfortunately, our litigious society targets ‘cracks in the armor’ and this can cause significant headaches for employers.
One service we offer is an Employer’s Business Review (EBR). This review checks a company’s standing on employment law. This stand-alone report is a basic, yet thorough, HR and OSHA review which identifies a company’s exposure to labor laws. Unfortunately, our litigious society targets ‘cracks in the armor’ and this can cause significant headaches for employers. This HR audit defines those ‘cracks’, and therefore a knowledgeable road map can be developed, keeping employees/attorneys from exploiting the 1500+ laws employers have to abide by.
The review consists of: Hiring Process; Pay Practice; Time Keeping; Employment Compliance; Managing Employee Performance; Termination; Worker’s Compensation; OSHA Compliance and Risk Management. With the current aggressive stance of labor attorneys, it makes good sense to check one’s standing on employment law.
Whether OHSA is inspecting your worksite because of an injury, high experience modifier for Workers’ Compensation, or it’s just a random inspection, having OSHA personnel walk your facility can be unsettling. Having professional help by your side can bring you confidence and a sense of well-being. If your company has already been inspected by OSHA, you only have 15 days after you’ve received the citations to respond, so don’t wait to call EG for help! If you do not respond to the citations within 15 days, the citations become final, and the employer is required to pay the entire proposed penalty and comply with OSHA’s requirements.
It is our mission to achieve a significant reduction or completely eliminate our client’s fines. OSHA officials may grant companies who have demonstrated “Good Faith” efforts such as hiring a safety consultant a 20% penalty reduction. Our OSHA compliance specialists will work hand in hand with your company through the entire process, including the informal conference, to completely close the case. OSHA fines can be costly. Accredited studies show that for every $1 invested in safety, companies can expect to see a $3 to $6 return on investment.
Conducting an internal investigation is one of the most challenging duties that HR professionals must take on. Workforce demographics are shifting. New laws are constantly changing. Managers make mistakes because they aren’t properly trained or they’re under pressure to resolve complaints quickly. Employees are more aware of their rights.
While many HR departments investigate every employee complaint, employers are legally mandated to investigate harassment, discrimination, retaliation, safety and certain other types of complaints. Employer’s Guardian can guide you through the process and help with conclusions.
Designing a compensation plan can be complex. A quality pay plan should reward performance and visa versa. At Employer’s Guardian, we design compliant pay plans customized to client needs to optimize business needs and control liability. We provide tools to compute wages correctly and our metrics-based plans have been successfully reviewed by the U.S. Department of Labor.
